ESA Phase 1 Inspections in Kentuckiana Now Available

There are some big differences between buying a residence and buying a commercial property. It sounds obvious to say, but most homes have always been homes on land that hasn’t been used for anything else. But that’s not true for commercial property. A commercial property may have started out as an automobile service station a couple decades ago, morphed into a retail outlet later, but is now a coffee shop!

The trouble these transitions cause, is that a buyer may not know the history of the property, but since 1980, the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, or SuperFund) holds every commercial buyer accountable to clean up environmental contamination on the property they own, even if they didn’t cause the contamination!

A Working Example

An entrepreneur eager to start their coffee shop finds a wonderful looking facility with great visibility and plenty of parking:

  • The gas pumps are gone.

  • The parking area has been resurfaced.

  • The garage doors have been replaced with large fixed glass windows.

It’s an ideal place to pursue their dream.

But what's hidden beneath the surface are:

  • The old fuel tanks,

  • waste oil tanks,

  • or other environmental hazards from decades ago that have been left untouched and are not leaking old fuel into the ground.

The entrepreneur buys the property, opens the coffee shop, and within a few years begins to notice depressions forming in their parking area, or worse the stream nearby gets tested by the EPA and they notice that there are petroleum products that are leaking into the water and begin to dig around to find the source of the leaks. Either way, the current owner is now on the hook for tens or hundreds of thousands of dollars of environmetal clean-up for the old fuel tanks that were left by the gas station decades ago.

The Solution

This is why it is so important for every business that buys a commercial property to get an Environmental Site Assessment (ESA) Phase 1 (Inspection only) before they close on the property! An ESA Phase 1 is a non-intrusive review of a commercial property's environmental history — required before most Commercial Real Estate (CRE) deals close.

During an ESA, the inspector:

  • Will look over the property and buildings for any current indications of environmental hazards;

  • Interview the current owner/tenant and others for their knowledge and use of the property

  • Research the history of the property and adjacent properties;

All to create a broad picture used to create the ESA report for the client.
